These terms govern use of the Scalys Agency website and the initial application process. Any creator-management engagement is governed by a separate written agency agreement signed by both parties.

2. Eligibility
This website and our services are intended exclusively for adults aged 18 or over who have legal capacity to contract. By applying, you confirm that the information you submit is accurate, that you control or are authorised to represent the relevant creator account, and that your activities comply with applicable law and platform rules.
3. Applications do not create an agency relationship
Submitting a form, arranging a call or receiving preliminary advice does not create representation, exclusivity, employment, partnership or an agency mandate. Scalys Agency may accept or decline an application at its discretion. A relationship begins only when both parties sign a specific written agreement.
4. Standard creator-agency principles
Unless a signed agreement expressly states otherwise, the following principles guide our engagements:
- The creator remains the owner of their name, likeness, accounts, original content and existing audience.
- The creator retains ultimate control over personal boundaries and may refuse content or positioning that falls outside the agreed brief.
- Any permission to use the creator's name, image or content is limited, revocable as provided in the agreement, and used only to perform or promote the agreed services.
- Account access is granted only to authorised personnel for defined operational purposes and does not transfer account ownership.
- Scalys Agency personnel and contractors with access to creator information are required to respect confidentiality.
- Services, territory, platforms, approval processes, deliverables, exclusivity if any, term and notice periods are specified in the individual agreement.
5. Creator responsibilities
Creators are responsible for supplying lawful, accurate and authorised material; respecting third-party rights and platform policies; disclosing relevant restrictions; cooperating with agreed production schedules; maintaining appropriate tax and business records; and promptly notifying Scalys Agency of security or account concerns.
Nothing in our services requires a creator to produce content beyond their documented boundaries.
6. Fees, commission and payment
Fees, commission percentages, revenue baselines, eligible revenue, payment timing, expenses, taxes and reporting are determined exclusively in the signed agency agreement. No fee or commission is created merely by using this website or submitting an application.
7. Performance statements and guarantees
Case studies and figures describe specific past engagements and are not promises of identical future results. Performance depends on the creator's starting position, audience, content, consistency, market conditions and platform decisions.
Any performance guarantee, revenue target, commission waiver or baseline protection applies only when included in a written offer or agency agreement, with its eligibility criteria, measurement period and remedy clearly defined.
8. Intellectual property
The website, Scalys name, design, copy, methods and original materials produced by Scalys Agency remain protected by applicable intellectual-property law. No website content may be reproduced commercially without permission.
Ownership and permitted use of campaign assets, scripts, edits, data, templates and jointly produced material are defined in the individual agency agreement. Nothing in these website terms transfers a creator's pre-existing intellectual property.
9. Confidentiality and privacy
Non-public business, account, revenue, identity, content and strategy information shared during discussions must be treated confidentially and used only to evaluate or perform the proposed relationship. Detailed confidentiality, security, data-processing and post-termination obligations are set out in the signed agreement. Website data is handled under our Privacy Policy.
10. Termination and handover
The applicable term and notice period are stated in the individual agreement. On termination, each party must complete agreed payments and a reasonable operational handover. Subject to legal retention duties, Scalys Agency will return or delete creator credentials and confidential materials according to the agreement. Account ownership remains with the creator.
11. Website availability and liability
We aim to keep the website accurate and available but do not guarantee uninterrupted or error-free access. To the extent permitted by law, Scalys Agency is not liable for indirect loss arising solely from use of this informational website or from third-party websites and platforms. Nothing in these terms excludes liability that cannot legally be excluded.
12. Governing framework
These website terms are governed by French law, without depriving a consumer of mandatory protections applicable in their country of residence. The parties should first attempt to resolve any concern in good faith by contacting contact@scalysagency.com. Jurisdiction and dispute-resolution provisions for paid services are specified in the individual agency agreement.
13. Changes
We may revise these website terms when our services or legal obligations change. Changes do not retroactively modify a signed agency agreement unless both parties agree in writing.
